Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and DoArt, a sole proprietorship (eenmanszaak) registered in the Netherlands with the Dutch Chamber of Commerce (Kamer van Koophandel) under KVK 58598464, with its place of business in Helmond, Netherlands. Dormetrics (operated at www.dormetrics.com) is a trade name of DoArt. In these Terms, “we”, “us”, and “Dormetrics” mean DoArt. By accessing or using Dormetrics, you agree to these Terms. If you do not agree, do not use the service.

1. What Dormetrics is (and is not)

Dormetrics is an informational risk-signal tool for people renting a home in the Netherlands. We surface red flags in a listing and, when you pay for it, tell you whether the person taking your deposit legally owns the property. Dormetrics is a risk signal, not a guarantee, and it is not legal, financial, or other professional advice. We never tell you a listing or a person is “safe”, and a clean result never removes your responsibility to verify independently. See our disclaimer.

2. We never handle your money

Dormetrics does not hold, transfer, or escrow deposits or rent, and is not a party to any tenancy. We are not an estate agent, a payment service, or an intermediary in your rental. Any payment you make to a landlord or agent is entirely between you and them — always pay by SEPA transfer to a Dutch IBAN and keep your own records.

3. Your account

Login is passwordless: we email you a one-time magic link. You are responsible for keeping access to your email inbox and devices secure and for all activity under your account. Tell us promptly if you suspect unauthorized use.

4. Credits & payment

The risk verdict is free. Owner-confirms are paid, as one-time credit packs or a recurring Search Pass that includes a set number of owner-confirms per billing cycle (extra confirms are charged at the stated overage rate). Prices are shown at checkout in euros (EUR) and may exclude taxes, which are added where required. Payment is processed by Stripe; we never receive your full card details. One owner-confirm credit equals one fresh land-registry lookup — results are never cached, so every confirm is a new query. We may change prices or pack contents prospectively; changes never affect credits you already bought. You can cancel a subscription at any time; it stops at the end of the current billing cycle.

5. Verified-Owner or it's free

If a paid owner-confirm cannot be completed — for example the land registry is unavailable, or it cannot return a usable match / no-match for the address and name you provided — we do not consume that credit, or we refund it. You only spend a credit on a confirm that actually runs.

6. Right of withdrawal & refunds

If you are a consumer in the EU, EEA, or United Kingdom, you have a statutory right to withdraw from your purchase within 14 days. Because owner-confirms are digital content supplied on demand, withdrawal works like this: within 14 days you may request a refund for any unused owner-confirm credits. Credits you have already used are not refundable, because that part of the service has already been performed; where you used some, we refund the unused portion and may deduct a proportionate amount for what was already supplied. After 14 days, or once a credit is used, that purchase is final. By completing your purchase you expressly consent to the immediate supply of your credits and acknowledge that you lose your right of withdrawal for any credit you have used.

For customers outside the EU, EEA, and United Kingdom, no statutory cooling-off period applies and all purchases are final once completed. The risk verdict is free, so you can try Dormetrics before you ever pay.

To request an eligible refund, email question.doart@gmail.com from your account email; we process refunds through Stripe, which reverses the corresponding credits. Initiating a chargeback instead of contacting us first may result in suspension while the dispute is resolved.

7. Acceptable use

You agree to use Dormetrics only to check listings and prospective counterparties in your own rental search. You agree notto: attempt any reverse “name → properties” lookup or otherwise use the service to profile, surveil, harass, or defame a property owner; use results to discriminate unlawfully; scrape, reverse-engineer, resell, or circumvent rate limits, security, or access controls; or submit content you have no right to submit. We may refuse, modify, or terminate access for any breach.

8. Accuracy & your responsibility

Automated signals can be wrong in both directions. A red flag is not proof of fraud, and a clean result is not proof a listing is genuine — a scammer can impersonate the real, publicly listed owner, an irreducible false-negative risk we cannot remove. You are solely responsible for how you interpret and use any result, and for your own rental decisions. Always view the property in person, pay by SEPA to a Dutch IBAN, and insist you can register at the address (BRP). Do not treat Dormetrics as your only check.

9. No reliance

Dormetrics is decision support, not a decision. You agree not to rely on any verdict as a guarantee of safety or legality. The final decision — whether to view, sign, or pay — is always yours.

10. Intellectual property

We own Dormetrics, the brand, and the software. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable licence to use your own results for your own personal, non-commercial purposes. If you send us feedback, you grant us a perpetual, royalty-free licence to use it.

11. Disclaimer of warranties

To the maximum extent permitted by law, Dormetrics is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, that every red flag will be caught, or any particular outcome. Nothing in these Terms removes or limits any mandatory rights you have as a consumer, including statutory conformity rights for digital content; those continue to apply.

12. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to Dormetrics shall not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) EUR 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, deposits, or anticipated savings arising from your rental decisions.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, or for any other liability that cannot be excluded or limited under applicable law.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold DoArt harmless from claims, damages, and costs arising from your misuse of Dormetrics, your breach of these Terms, or your unlawful use of any result. This does not affect your mandatory rights as a consumer.

14. Suspension & termination

We may suspend or terminate access — with or without notice — for breach of these Terms, suspected fraud or abuse, non-payment, or unlawful use. You may stop using Dormetrics at any time and delete your account from the app.

15. Changes to these Terms

We may update these Terms. We will post the updated version with a new date; material changes take effect when posted and your continued use means you accept them. If you do not agree, stop using Dormetrics.

16. Governing law & disputes

These Terms are governed by the laws of the Netherlands, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive forum is the competent courts of Oost-Brabant, Netherlands. If you are a consumer, you keep the protection of any mandatory provisions of the law of your country of residence, and you may also bring proceedings in your local courts where the law allows. EU consumers may also refer a dispute to a competent consumer dispute-resolution (ADR) body in their own country. Please contact us first so we can try to resolve things directly.
